All employees must acknowledge receipt of this policy and complete sexual harassment and assault training within the first six months of their employment.
This training is designed to help faculty and staff recognize and understand their responsibility to report all instances of sex-based discrimination and violence against members of the university community. Employees are encouraged to meet the training requirement through the available online modules, however in-person training may be scheduled, as needed.
Each employee should receive refresher training at least every three years. All students who are new to the university, including transfer and graduate students, must complete the online training modules before or during their first semester of enrollment at the university. This training is designed to help students learn about consent, how to help and safely intervene in a potentially harmful situation, where to report allegations, and available resources for those who have been harmed by sex-based discrimination or violence.
At the conclusion of a hearing and appeal if any , the Chancellor shall certify that the substantial rights of student complainants and respondents as established in Act of , Ark. Code Ann. The certification shall be maintained in the administrative file. Inquiries regarding the application of Title IX and 34 C. At the time that a formal complaint is filed, the complainant must be participating in or attempting to participate in an education program or activity of the University.
An education program or activity includes locations, events, or circumstances over which the University exercises substantial control over both the respondent and the context in which the sexual harassment occurs, and also includes any building owned or controlled by a student organization that is officially recognized by a postsecondary institution.
